Card surcharge wording in Australia: before and after

Before

Card surcharge 1.5%

After

Prices include card processing costs

Delete the surcharge line and build card costs into your prices. The ACCC says card costs should be reflected in overall prices.

Before

Sunday surcharge applies

After

A surcharge of [percentage] applies on Sundays

Weekend and public holiday surcharges are still allowed if they apply however people pay. Cafes and restaurants should state the percentage and the days, at least as prominently as the most prominent menu price.

Don't just rename a card surcharge as a service, admin or processing fee: the ACCC says that may be misleading. General information only, not legal advice.

3. Manual checklist (things this tool can't read)

What changed on 1 October 2026?

From 1 October 2026, businesses in Australia can no longer add a surcharge for payments made with Visa, Mastercard, American Express or eftpos cards (ACCC: Card surcharges).

Which surcharges are still allowed?

Fees that don't depend on how the customer pays, such as a weekend or public holiday surcharge, are not covered by this change. A cafe or restaurant with a weekend or public holiday surcharge must say "A surcharge of [percentage] applies on [day or days]" on the menu, at least as prominently as the most prominent price (ACCC: Price displays).

Can I build card costs into my prices?

Yes. The ACCC says card costs should be reflected in overall prices. Don't rename a card surcharge as a service, admin or other fee, which the ACCC says may be misleading, and don't blame a price rise on the change if other costs also went up.
